PROTECTING CONSUMERS IN THE FINANCIAL MARKETPLACE

From credit cards to home mortgages to student loans to bank fees, the practices of Wall Street reach into the living rooms, dorm rooms and wallets of virtually every Oregonian, from cradle to grave.

In 2010, after the financial collapse, the subsequent multi-trillion dollar government bailout of Wall Street, and the public outcry that followed,  Congress passed the Wall Street Reform and Consumer Protection Act. It was the country’s first major strengthening of financial marketplace rules in over 75 years.

The goals of the 2010 law are important: prevent a future financial meltdown and taxpayer bailout and protect consumers and investors from deceptive bank practices. For consumers, the law's centerpiece is its establishment of the new Consumer Financial Protection Bureau.

HISTORY OF A CRISIS

The roots of the current financial crisis are, in large part, due to activities of Wall Street’s largest players, and a series of decisions by federal policy makers to relax long-standing bank regulations.

After the Great Crash of 1929, a set of marketplace rules were enacted to stabilize the financial markets. These rules were intended to check the more excessive impulses of Wall Street, ensure that they did not take extreme risks with their customers’ money, and provide a basic degree of protection for bank deposits.

Financial markets remained relatively stable for about fifty years. Then, about 25 years ago, Congress weakened these laws several times, causing many Wall Street banks to take on increasingly risky behavior.

Nearly 1,500 Washington, D.C. lobbyists representing Wall Street firms pushed hard against passage of the law, and its effectiveness will be determined by hundreds of decisions currently being made by little-known government agencies that are in charge of implementing the law.

And there is a similar by Wall Street lobbyists currently underway in an attempt to influence the implementation of the law.

U.S. PIRG Urges Appeals Court to Block President Trump's Illegal Appointment of Mick Mulvaney as Acting Director of the CFPB | Mike Landis

Last week, the U.S. Court of Appeals for the D.C. Circuit heard oral argument in English v. Trump, a case involving a challenge to President Trump’s appointment of Mick Mulvaney as the acting director of the Consumer Financial Protection Bureau (CFPB). U.S. PIRG, along with nine other consumer advocacy groups, has filed two amicus briefs in the case (one in the trial court and one in the appellate court) in support of the plaintiff, Leandra English, who is the CFPB’s deputy director and, we believe, the rightful acting director of the agency.

Hint: We agree with and supported several states that brought the case on behalf of their citizens. We also make the point that unless the states prevail, the practices of dominant tech platforms like Google and Amazon and Facebook will also be immunized from action.

The U.S. Consumer Financial Protection Bureau’s (CFPB) independence from external political influence is crucial to the agency’s mission of protecting consumers, 10 groups, including U.S. PIRG Education Fund, told a U.S. appellate court today in an amicus brief filed in the U.S. Court of Appeals for the District of Columbia Circuit. The groups are supporting the appeal of CFPB Deputy Director Leandra English in her lawsuit against the President and OMB Director Mick Mulvaney over the proper leadership of the Bureau in the absence of a Senate-confirmed director.

Statement on Equifax’s Lock & Alert Product Announcement

Our statement on the today's launch by Equifax of Lock & Alert, a service that will let consumers lock and unlock their Equifax credit reports indefinitely for free to stop new account identity theft. This service, similar to state mandated credit freezes, only blocks access to Equifax credit reports, not credit reports at the other two bureaus, Experian and TransUnion. U.S. PIRG's advice: Blocking access to your credit reports at all three national credit bureaus remains the best action consumers can take after the Equifax breach, whether they were affected by it or not.

Lead In Fidget Spinners

While lead in toys has become less prevalent in recent years, U.S. PIRG Education Fund tested several models of one of today’s hottest toys, fidget spinners, for the toxic heavy metal. Laboratory results indicated that two fidget spinners purchased at Target and distributed by Bulls i Toy, L.L.C. contained extremely high levels of lead. U.S. PIRG Education Fund calls on Target and Bulls i Toy to immediately recall these two fidget spinners and investigate how such high levels of lead were found in these toys. Older Consumers in the Financial Marketplace

Older consumers are at risk of harm from predatory financial behavior. An analysis of more than 72,000 financial complaints submitted by older consumers (those 62 years of age and older) to the Consumer Financial Protection Bureau (CFPB, or Consumer Bureau) and contained in its Consumer Complaint Database suggests that mistreatment of older consumers by financial companies is widespread.

Protecting Those Who Serve

This report, the tenth in our series on the CFPB's Public Consumer Complaint Database, is called "Protecting Those Who Serve." It is an analysis of over 44,000 consumer complaints from active-duty servicemembers, veterans and their families. The End for "Rent-A-Tribe" Payday Lending Schemes? | Ed Mierzwinski

This month, Scott Tucker, a payday lender who used his proceeds to fund a LeMans racing team, was sentenced to 16 years in jail on federal racketeering and other charges.   Last fall, his former business partner Charles Hallinan, known as the Philadelphia Main Line "godfather" of payday lending, was also convicted of federal racketeering charges. Tucker and Hallinan's main business model? Their claim that their payday loan enterprises were for the benefit of Native American tribal partners and therefore subject to tribal immunity. The authoritative public interest law firm Public Justice speculates: "Tribal Immunity" may no longer be a Get-Out-of-Jail Free Card for payday lenders." It's about time.
